  1. Participation in this Canon Australia Summer Cash Back 2017/2018 promotion (Promotion) is deemed acceptance of these terms. Information and instructions on how to participate form part of these terms.
  2. The purchase period starts on 14 November 2017 and closes on 15 January 2018 (Purchase Period).

    Eligibility

  1. The promotion is open to individual Australian residents and is not available in conjunction with any staff discounts available to officers and employees of the Promoter or its related companies (Participants).

    Eligible Purchase

  2. An “Eligible Purchase” is the purchase of any new (not pre-owned) Eligible Product (listed in clause 7) during the Purchase Period from Canon Australia’s official online store (http://store.canon.com.au) or from an authorised Canon Australia retailer in the Canon Australia distribution channel.
  3. See www.canon.com.au/summercashback to find authorised Canon Australia retailers. If in doubt, or a particular retailer is not included in this list, please contact the Promoter first to confirm whether the retailer is an authorised Canon Australia reseller. Sydney International JB Store is excluded from the promotion.
  4. Canon-branded products purchased from any source other than Canon Australia’s official online store or from an authorised Canon Australia retailer in the Canon Australia distribution channel (including ‘grey’, ‘parallel’ or ‘direct’ imports) are not Canon Australia products and do not constitute an Eligible Purchase.

    How to make a Claim

  7. A Participant can submit a claim for Cash Back when they make an Eligible Purchase (Claim).
  8. The online claim form must be completed and submitted for each separate Eligible Product purchased. If multiple Eligible Products are purchased in one transaction, a separate Claim must be made for each Eligible Product, though the same receipt may be attached to each Claim.
  9. Only one Claim may be submitted per Eligible Product.
  10. To submit a Claim, Participants must visit canon.com.au/cashback and input their details, including their full name, valid email address, and bank account details (to receive an electronic funds transfer (EFT)) OR postal address (to receive a gift card), then either:
    1. submit the Claim online along with an uploaded copy of their receipt by 12 February 2018; or
    2. mail a copy of their receipt together with a printed copy of the completed Claim form to “Canon Cash Back, PO Box 610, Artarmon, NSW 2064” in time to be received by last mail on 12 March 2018.
  11. Participants can contact the Promoter on 1800 960 733 or email cashback@canon.com.auif they need assistance accessing and processing the claim form.
  12. A Participant forfeits their right to a Cash Back if they fail to produce a receipt.
  13. No responsibility will be accepted by the Promoter for late or misdirected claims and no correspondence will be entered into.

    Payment

  14. Claims will be paid to the Participant named on the valid Claim form submitted to the Promoter.
  15. It is the responsibility of the Participant to provide the correct details. Delays and non-payment of Claims that arise as a result of supplying incorrect details are the responsibility of the Participant.
  16. Claims will be processed within 30 working days of the Promoter verifying the claim by sending an VISA Gift Card or completing an Electronic Funds Transfer (EFT).
  17. The Participant cannot change their preferred payment method after submitting the Claim.
  18. If a Participant chooses to receive a Gift Card, this is subject to the issuer’s terms of use (available at https://ichoosegift.mycardplace.com/cholder/). The VISA Gift Card comes already activated and will be valid for 12 months from the date of being posted by the Promotor.
  19. Any bank transaction fees associated with clearing funds, or any other costs associated with accessing the promotion website, scanning or copying receipts, or otherwise submitting a Claim is the responsibility of the Participant.
  20. Claims are not transferable or assignable.

    Collection of Personal Information

  21. The Promoter collects personal information in connection with this promotion to conduct the promotion. The Promoter may, for the purpose of conducting this promotion, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to regulatory agencies. Participation is conditional on providing this information.
  22. Personal information collected by the Promoter in connection with this promotion will be managed in accordance with its Privacy Policy (available at www.canon.com.au/Privacy-Policy), which contains information about access, correction and complaint processes.  

    Conditions that may invalidate a Claim

  23. The Promoter reserves the right at any time to verify the eligibility of Participants and the validity of a Claim (including contacting the place of purchase), and to invalidate any Claim that is not in accordance with these Terms and Conditions, or to disqualify any Participant who tampers with the Promotion.
  24. A Participant forfeits their right to make a Claim and to a Cash Back if the Eligible Product is subsequently returned or refunded (and except where the product is replaced).
  25. If a Participant receives their Cash Back and subsequently returns or refunds the Eligible Product (except in cases of replacement), the Participant must immediately return the Cash Back money to the Promoter. Claims taken as Gift Cards may be deactivated by the Promoter and where this is not possible, must be returned by the Participant as a money transfer to the Promoter. Where the Participant fails to do so, the Promoter reserves the right to issue the Participant with an invoice for the applicable Cash Back amount, which is to be paid to the Promoter’s nominated bank account within 14 days. The Promoter reserves the right to take appropriate action where the Participant breaches this clause or does not pay the invoice.
  26. Incomplete or illegible Claims may be deemed invalid, although errors and omissions may be accepted at the discretion of the Promoter.
  27. The failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  28. If this promotion is interfered with in any way or is not capable of being conducted as anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to:
    1. disqualify any Participant; or
    2. modify, suspend, terminate or cancel the promotion as appropriate.

      General

  29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees).
  30. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion including: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any Claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; and (d) any tax liability incurred by a Participant.
  31. All money amounts in these Terms and Conditions are in Australian Dollars inclusive of GST.
  32. If any provision of these Terms and Conditions is unenforceable for any reason, such provision shall be severed from these Terms and Conditions and the remaining Terms and Conditions will remain in full force and effect.
  33. These terms are governed by the laws in New South Wales. All Entrants submit to the non-exclusive jurisdiction of the Courts of New South Wales.

Participation in this Canon Australia Summer Cash Back 2017/2018 Suroard Giveaway Promotion – Michaels (Promotion) is deemed acceptance of these terms. Information and instructions on how to participate form part of these terms.

The Purchase Period starts on 14 November 2017 and closes 15 January 2018 (Purchase Period).

Eligibility

The promotion is only open to individual Australian residents who are 18 years of age or over, and who are not employees (or their immediate family members) of the Promoter, its related companies or agencies associated with this Promotion (Participants) who make an

Eligible Purchase at Michaels (Promotion Store). Participants under the age of 18 must have the consent of their parent or legal guardian to enter this Promotion and to agree to its Terms.

Eligible Purchase

An Eligible Purchase is the purchase of any new (not pre-owned) Product under the Promotor’s “Canon Australia Summer Cash Back 2017/2018 Promotion” (full list at canon.com.au/summercashback) during the Purchase Period from the Promotion Store (Eligible Purchase).

How to Enter

During the Purchase Period, Participants must answer the Question stated in clause 6 and submit a copy of their receipt and their name, email and phone number on the tear pad at the cash register of the Promotion Store (Entry).

Participants must answer the Question “what memories will you be capturing this summer?”

Entry Requirements

Participants can only submit their own original work. Entries must not contain any material protected by third party copyright or other intellectual property rights.

Only one Entry per Eligible Purchase.

Prize

The Prize is a suroard produced by Hayden Shapes with an Aquabumps image printed on the suroard (RRP$1,675) (Prize).

Judging

Judging will be carried out after close of the Purchase Period by a Canon representative (Judge). Judging will be based on the Entry which the Judge deems to be the most creative. The Judges’ decision is final and no correspondence will be entered into.

Claiming the Prize

The Winner may be required to provide personal information (such as a home address) in order to claim the Prize.

If the Winner does not claim its prize by the time indicated by the Promoter, or if a Winner cannot be contacted, or cannot provide suitable proof as to Eligibility, or compliance with these Terms and Conditions, it will forfeit the Prize. If the Winner forfeits the Prize, the Judge

will select a runner-up Winner.

The Prize, or any unused portion of a Prize, is not exchangeable and cannot be taken as cash.

Participant’s Warranties and Indemnity

Each Participant warrants to the Promoter that (a) it has complied with the Entry Requirements; b) no Entry submitted by it will cause harm to any person or entity; and (c) it has and will comply with all applicable laws and regulations including without limitation copyright

law and privacy law when participating in this Promotion. Each Participant agrees to indemnify the Promoter against all costs and claims arising from a failure by it to comply with these Terms and Conditions.

Each Participant agrees that it is fully responsible for each Entry it submits, and is fully responsible for any equipment, or other costs required for, or associated with an Entry. To the fullest extent permitted by law, the Promoter excludes any liability for such Entries or any

costs borne by the Participant relating to such Entries.

Conditions that may Invalidate Entries, Participants or the Promotion

The Promoter reserves the right to disqualify any Entry where it reasonably suspects that the Entry fails to comply with relevant law, breaches these Terms and Conditions, or the Participant has failed to meet the Eligibility criteria.

If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, the Promoter reserves the right to the fullest extent permitted by law and subject to any written directions from a regulatory authority, to modify,

suspend, terminate or cancel the Promotion.

Collection of Personal Information

The Promoter collects Personal Information in order to conduct the Promotion. The Promoter may, for the purposes of conducting the Promotion, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to

Terms & Conditions

1. The Promoter is Nikon Australia Pty Ltd (ABN 34 121 761 537).

2. The Promotional Website is the part of the website maintained by or on behalf of the Promoter at www.promotions.mynikonlife.com.au/cashback which relates to the Rewards. The Rewards are any cashback, discounts, gift vouchers, goods, services or other rewards that may be offered by the Promoter to qualifying consumers from time to time and which are described by the Promoter as ‘Local Rewards’ or which are otherwise described by the Promoter as being offered under these terms and conditions.

3. A Participant is any person who applies for a Reward through the Promotional Website, or who has accessed or entered details into the Promotional Website for the purposes of viewing available Rewards or applying for a Reward.

If applying for a Reward from the Student Cashback Offer Promotion, the Participant must use their own Student email address provided by their high school or tertiary education institution when registering on the Promotional Website, and must select the ‘STUDENT OFFER’ option of their valid Product from the Product menu. Current student identification and photo ID must be emailed to contact@promotions.mynikonlife.com.au along with the Participant’s registration Claim Code which is provided after completing the online registration on the Promotional Website for verification and final approval before eligible for the Reward. This offer is not to be used in conjunction with any other offer or Reward.

4. Information on Rewards, how to apply for them, and other details contained on the Promotional Website or within any promotional advertisements form part of these terms and conditions. By applying for a Reward or entering details into the Promotional Website, Participants acknowledge that they have read, understand and agree to be bound by these terms and conditions.

5. Only individuals who reside in Australia and who have an Australian bank account may apply for a Reward. If an individual is aged under 18 years, they additionally must obtain the consent of a parent or legal guardian before applying for a Reward. If a Participant who is otherwise entitled to receive a Reward under these terms and conditions is under the age of 18 years, the Promoter may (in its discretion) decline to provide the Reward to that Participant until a parent or legal guardian of that Participant agrees (in a form acceptable to the Promoter) to ensure that the successful Participant complies with these terms and conditions.

6. Any available Rewards, along with the criteria that a Participant must fulfil to apply for a Reward, the period within which the Participant must apply for the Reward and how the Participant must apply for the Reward (collectively, the 'Reward Criteria') will be set out at the Promotional Website from time to time. Rewards will only be available for a limited period and the Promoter may add to, remove or change (in whole or in part) the available Rewards and the Reward Criteria for those Rewards on the Promotional Website from time to time. Participants may need to enter various details into the Promotional Website in order to see whether any Rewards are available to them at that time and the relevant Reward Criteria. Participants acknowledge and agree that, from time to time, there may be no Rewards available under these terms and conditions.

7. To be eligible to apply for a Reward: (a) a Participant must have purchased a new Nikon Digital SLR camera, a new Nikkor lens, a new COOLPIX camera, a new KeyMission action camera or a new Nikon accessory (each a 'Product') (b) the model of that Product must be identified on the Promotional Website as a model to which the Reward applies; (c) that Product must have been purchased from a Nikon Australia Authorised Reseller (as defined at the end of these terms and conditions); (d) the purchased Product must have been paid for in full by the Participant within the promotional period in which the Participant is applying for the Reward; (e) the Participant must register for their reward on The Promotional Website within forty (40) days of their purchase date unless The Promoter has specified elsewhere in writing and (f) the Participant must comply with all other Reward Criteria in relation to that Reward.

A Participant may only claim for, and will only receive, one (1) Reward for each available model of the Products. If more than one (1) claim for a Reward is submitted for the same model of the Products, the Promoter will consider the one (1) Reward claim and disregard other Reward claims, by that Participant in respect of that model of the Product, whether received at the same time or subsequently.

The Participant must immediately return any Reward they receive in connection with that Product to the Promoter if they return the Products for a refund or credit. The Promoter reserves the right to issue the Participant with a request for the return of funds. Additionally, if the funds are not returned upon request, the Promoter reserves the right to issue the Participant with an invoice to the value of the Reward amount received, which is to be paid to the Promoters nominated account within fourteen (14) days. Upon failure to make contact with the Promoter and/or meet these terms, the Promoter reserves the right to report to the police and/or other relevant authorities, any claim(s) it suspects to be fraudulent.

8. Participants who are eligible to apply for a Reward will only receive that Reward if they fulfil each of the Reward Criteria for that Reward, including by applying for that Reward within the time period required by the Promotional Website and in the manner required by the Promotional Website and these terms and conditions. Any application for a Reward that fails to meet these requirements will be deemed invalid. Applications will also be deemed invalid if they are incomplete, incorrect or incomprehensible, or if they are stolen, forged, mutilated or tampered with in any way.

9. The Promoter may decline any invalid application, although it reserves the right (in its discretion) to contact (or attempt to contact) the relevant Participant to attempt to resolve any issues with an invalid application that are capable of resolution. If, following contact with the relevant Participant, such issues are resolved by the relevant Participant to the satisfaction of the Promoter, the Promoter may accept the updated application as a valid application.

10. Where a Participant's application for a Reward is successful, the Promoter will provide that Reward to the postal address, email address or appropriate account nominated for the receipt of that Reward in that application (as applicable).

11. Reward applications will be deemed to have been made at the time of their receipt by the Promoter and not at the time of transmission. Participants may only apply for Rewards in their own name and using their own personal details, and may only provide their own address and account details in their application for the receipt of a Reward. Additionally, a person must not apply for a Reward to which another person is entitled, whether on their behalf or otherwise. THE PROMOTER TAKES THE ISSUE OF FRAUD VERY SERIOUSLY, AND RESERVES THE RIGHT TO DEEM INVALID AND REPORT TO THE POLICE AND/OR OTHER APPROPRIATE AUTHORITIES ANY APPLICATIONS FOR REWARDS WHICH IT SUSPECTS TO BE FRAUDULENT OR OTHERWISE UNLAWFUL. The use of automatic software or similar devices to apply for Rewards or enter details into the Promotional Website is prohibited.

12. Management, employees and contractors of either the Promoter or any Nikon Australia Authorised Reseller are not eligible to apply for Rewards.

13. If a Participant is required to submit any written material, any photographs or any other material in which intellectual property rights subsist ('Works') in order to apply for a Reward, those Works must be: (a) the original independent creation of the Participant; (b) owned by the Participant; and (c) free of any claims, including copyright or trademark claims, and must not: (i) have been published previously; or (ii) infringe any person's intellectual property rights. Additionally, the Promoter may in its discretion deem an application to be invalid if it includes any content which, in the opinion of the Promoter, contains profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language, or which is otherwise objectionable.

14. The Promoter may use, reproduce and publish any Works in any media, for any purpose, including for the purpose of: (a) advertising, promoting, marketing or publicising this promotion; or (b) any future promotional, advertising, marketing and/or publicity activities of the Promoter.

15. Rewards that are goods or services (or in the form of a gift voucher or discount) are not exchangeable or redeemable for cash. Any stated value for Rewards is based on the recommended retail value of the Reward in Australian dollars, inclusive of GST. The Promoter accepts no responsibility for any variation in the value of the Reward. If the Reward is unavailable, for whatever reason, the Promoter reserves the right to substitute the Reward for an alternative Reward of equal or greater value. To the extent permitted by law, no compensation will be payable if, for any reason, a successful Participant is unable to use a Reward as stated.

16. The Promoter reserves the right, at any time, to verify the validity of applications and Participants (including a Participant's identity, age, place of residence, address or account details (as applicable) for the receipt of the Rewards and, where applicable, proof of purchase). Proof of identity, age, residency, address or account details and purchase considered suitable for verification is at the discretion of the Promoter.

17. The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

18. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

19. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to modify, suspend, terminate or cancel the promotion, as appropriate.

20. The Promoter will make reasonable efforts to deliver the Reward(s) to successful Participant(s). To the extent permitted by law, the Promoter and its suppliers take no responsibility for Rewards damaged or lost in transit, and once a Reward has left the premises of the Promoter or its supplier, the Promoter will not be responsible for any delay or failure to deliver, or damage caused to the Reward during transit. Any part of any Reward that is not taken for any reason is forfeited. Any taxes which may be payable as a consequence of a Participant receiving a Reward are the sole responsibility of the Participant.

21. Under the Australian Consumer Law (and other similar legislation of Australian states and territories), certain statutory guarantees are conferred in relation to the supply of goods or services to a Consumer ('Consumer Guarantees'). Where a Participant as a Consumer acquires goods and services under these terms and conditions from the Promoter as a supplier and:

(a) the goods or services are PDH Goods or Services, the operation of the Consumer Guarantees cannot be, and are not in these terms and conditions, excluded, restricted or modified; or

(b) the goods or services are not PDH Goods or Services, the Promoter limits its liability for a failure to comply with any Consumer Guarantee (other than where to do so would otherwise cause all or part of this clause to be void) to (at the Promoter's option): (i) in the case of goods, repairing or replacing the goods or paying the cost of having the goods repaired or replaced; and (ii) in the case of services, re-supplying the services or paying the cost of having the services re-supplied,

and the Promoter does not exclude or limit the operation of the Consumer Guarantees under any other provision of these terms and conditions or in any other manner and Participants agree it is fair and reasonable in all the circumstances for the Promoter's liability to be so limited.

22. The Promoter excludes from these terms and conditions all representations, guarantees, conditions, warranties, rights, remedies, liabilities and other terms that may be conferred or implied by statute, general law or custom, except any guarantee or right conferred under any legislation (including the Australian Consumer Law), the exclusion of which would contravene legislation or cause part or all of this clause to be void.

How to Claim

    1.     2. The use of the eftpos gift card is subject to terms and conditions, including the following:
      1. The eftpos gift card can be used anywhere eftpos is accepted. The eftpos gift card cannot be used to withdraw cash. Some merchants may choose not to accept the eftpos gift card.
      2. The eftpos gift cards require activation prior to use. Claimants must refer to the instructions provided with the issuing letter or on the back of the card to activate. The eftpos gift card must be activated within six (6) months from the date of the issuing letter. To activate the card, claimants must go online to www.activ8card.com.au or by phoning 1800 446 347. Claimants must enter their first name, last name, email address and card number as the requested details. Once activated, funds are available from 12pm the following business day.
      3. The eftpos gift card is valid for twelve (12) months from the date of activation, after which time it will expire.
      4. The eftpos gift card cannot be redeemed for cash, reloaded, returned for a refund, have their balances consolidated to a new gift card, or be replaced or extended after expiry (whether this means after the activation period expiry or 12 month expiry after activation) or have their value replaced after expiry and are not legal tender, account cards, credit or debit cards or securities.
      5. eftpos gift cards will be deemed void if they are defaced, mutilated, altered or tampered with in any way.

    3. If a claimant returns a Participating Product purchased for any reason other than a standard exchange for the same product, the claimant's claim will be rendered invalid, and if the claimant has already received the gift, the claimant will be required to return the gift, in full, to the Promoter at their own cost.

General Terms

  1. The Promoter reserves the right, at any time, to verify the validity of claims and claimant's (including a claimant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these terms and conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  2. Claim forms may be subject to follow up enquires or investigations or security and verification checks as the Promoter determines to apply in its absolute discretion. The claim form will be ineligible if it (and/or purchase receipt/tax invoice) is mutilated, illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way, or if these documents fail any of the Promoter's security and verification checks.
  3. Incomplete, indecipherable or illegible claims will be deemed invalid.
  4. Multiple claims permitted for multiple purchases only. Each claim has to be submitted separately on the website. Only one (1) claim can be made for a single purchase.
  5. Claimants must retain their original purchase receipt/tax invoice as proof of purchase. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation and forfeiture of any right to a gift. The Purchase receipt/tax invoice must clearly specify the participating retailer where the Participating Product was purchased, purchase date (showing purchase was made during the Purchase Period and prior to submission of the online claim form), Panasonic product model number and purchase cost.
  6. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant
  7. Successful claimants will be notified by email.
  8. The Promoter's decision is final and no correspondence will be entered into.
  9. Claims must be successfully verified by the Promoter before a gift will be awarded. The value of the gift is correct at the time of printing. The Promoter accepts no responsibility for any discrepancy in the gift value.
  10. The Promoter shall use all reasonable efforts to ensure that all approved claims will be fulfilled within eight (8) weeks from the time the claim is validated. The Promoter accepts no responsibility should the delivery take longer than eight (8) weeks for reasons beyond its reasonable control.
  11. If for any reason a claimant does not take a gift at or by the time stipulated by the Promoter, then the gift will be forfeited.
  12. Claimants are required to provide all details requested by the Promoter. In the event that a claimant fails to provide any of the details requested, the claim will be invalidated and no corresponding gift will be awarded to that claimant.
  13. Claimants must have fully paid for the Participating Product before they are eligible to submit a claim.
  14. Claimants are responsible for ensuring that they provide the Promoter with accurate details relating to their claim. In the event that a claimant provides any incorrect details on their claim form, the Promoter shall not be liable for the gift not being awarded or being delivered to the wrong address. In either of these cases, the gift will be forfeited by the original claimant and no additional gift will be awarded.
  15. If the gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the gift with a gift to the equal value and/or specification.
  16. Gifts are not transferable or exchangeable and cannot be taken as cash.
  17. Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  19. Any cost associated with accessing the promotional website is the claimant's responsibility and is dependent on the internet service provider used.
  20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  21. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a gift.
  22. The Promoter shall not be responsible for any delays in supply of the gift to the claimant. The Promoter shall additionally not be responsible for any delays caused as a result of inbound transportation, disruptions (including but not limited to strikes, weather, postage delays, etc.) which are caused by events, which are beyond the control of the Promoter and/or the supplier of the gift.
  23. As a condition of claiming a gift, each claimant must when requested sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
  24. The Promoter reserves the right to extend the promotion without notice and at their discretion.
  25. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and gift suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.panasonic.com/au/privacy-policy.html. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose claimant's personal information to any entity outside of Australia. However, from time to time, Panasonic may require entrants to provide PI directly to its related bodies corporate, which are based overseas, for the purposes of providing support to a claimant for specific Panasonic products. Panasonic is not responsible for any PI provided by claimants directly to such entities, which are not bound by the Privacy Act 1988 (Cth). Entrants may review the relevant entities' privacy policies to check how they will deal with PI, before providing their PI to them.

These are your card-holder Terms and Conditions if your card has 19 digits and begins with 5021 2510. Please read them carefully. Please activate your card immediately.

In these Terms and Conditions, "Card" and "Cards" means the Gift card, issued by iGoDirect on behalf of Panasonic Australia Pty Ltd, referred to as "the issuer". "You" and "Your" means the person who has received the Card. "We", "Us" and "Our" means iGODirect Group Pty Ltd, ABN 17 110 897 320.

By accepting and using your Gift Card, you are agreeing to these Terms and Conditions.

The Card is not a credit card; it is a prepaid stored value card. We reserve the right to issue or refuse to issue or cancel a Card at our discretion.

Card Access: The Card is a gift card that can be used at hundreds of thousands of locations, anywhere EFTPOS cards are accepted at point-of-sale.

Card Limitations: You must have sufficient, available funds to pay for all Card transactions at merchants. If the purchase amount is greater than the available funds, the difference may be paid for with cash, cheque, and credit or debit card, subject to the policy of the merchant. If the merchant attempts to process the Card for more than the available funds, the transaction will be declined and a transaction attempt fee maybe applied. You may confirm your available balance 24 hours a day, seven days a week by visiting www.activ8card.com.au and clicking on the Check Your Balance button at the top of the page and following the prompts or by phoning 1800 446 347 (between 9am and 5pm AEST/AEDST Monday to Friday – excluding public holidays). You may only use your Card in the manner and for the purposes described in these Terms and Conditions. Your Card may not be used for illegal transactions or for any type of pre-authorised transaction such as recurring monthly payments, dues or fees.

Important things you need to know about using your Card:

  • You MUST activate your Card before use, either online at https://activa8card.com.au or by phoning 1800 446 347.
  • If your Card does not have enough funds to pay for the amount of a transaction, your transaction will be declined.
  • When making a purchase greater than the face value of the card, alert the cashier to use the following payment method:
    1. Utilise other form of payment to cover amount greater than what is available on the Card.
    2. Advise the Cashier to use remaining balance on the Card as the second form of payment.

    Please note: The merchant may choose not to accept this method. In this case, you must check with the merchant if and how you can make a purchase that exceeds the available balance by paying for the difference using other means. 

    Documentation of Transactions: At the time of purchase, you will receive a receipt for the transaction. Retain the receipt for your records. You will also have access to your balance and transaction history, which is accessible online – click the "Check Your Balance" button at the top of the page and follow the prompts to do so. 

    Disputes with Merchants: You agree to make a good faith effort to settle all disputes about purchases you make using your Card with the merchant who accepted the Card.

    Disclaimer of Liability: In providing the Card service to you, we disclaim any duty or responsibility other than those expressly set forth in these Terms and Conditions: The issuer is not liable expressly for the following:

    • If through no fault of ours, the cardholder does not have enough money on the Card to cover the transaction; or
    • If the transaction exceeds the cardholder's available funds; or
    • If the terminal or system was not working properly; or
    • If circumstances beyond our control (such as flood or fire or other natural disaster) prevent the transaction, despite reasonable precautions that we may have taken; or
    • If there are other exceptions stated in these Terms and Conditions or provided by law.

    Expiration: Your Card expires on the expiration date that appears on the back of the Card, except where prohibited by law. After the Card has expired, it is no longer valid: All transactions will be declined and any remaining balance is forfeited.

    Termination: The Card shall remain our property; we may, at any time and without prior notice, cancel your Card and have you return it to us; Termination of the Card will not affect prior transactions or obligations existing at the time of termination. Upon termination, we will waiver the remaining balance.

    Amendment: We may amend these Terms and Conditions by emailing a notice to you at your last email address on our records at least 21 days prior to the effective date of any amendment that results in an increased fee or charge, an increase in your liability, a reduction in Card services, or stricter transaction limitations.

    Assignment: You may not transfer or assign your Card rights to any other person. We may assign our obligations to you under these Terms and Conditions without your consent or notice to you.

    Severability/No Waiver: If any provision of these Terms and Conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. Our failure to enforce the strict performance of any provision of these Terms and Conditions will not constitute a waiver of our right to subsequently enforce such provision or any other provisions of these Terms and Conditions.

    Governing Law: These Terms and Conditions, the Card and all transactions hereunder are subject to the laws of the Commonwealth of Australia and the financial services Acts rules and regulations.

    Notice of Errors: If you think a receipt is wrong or you have a question concerning a Card transaction, call our Card Services Number 1800 446 347, or visit online as soon as you can. We must hear from you no later than 15 days after the transaction date and you must provide the following information: a) your name and Card number; b) a description of the error or the transaction you are unsure about, and an explanation as to why you believe it is an error or why you need more information c) the dollar amount of the suspected error: If you tell us verbally, we may require that you send us your complaint or question in writing within 10 business days.

    Important Notes:

    • Any residual value on the Card after expiry will not be refunded to the cardholder or card purchaser.
    • Please keep your Card secure. If the card is stolen it may not be replaced and your funds may be forfeited. In the event your card is lost or stolen, please report it to Card Services on 1800 446 347 as soon as possible. Cards will only be replaced at the issuer's discretion where there are remaining funds available and you can appropriately identify yourself as the card owner or purchaser. If approved for replacement, fees will apply and the same card expiry will be applied to the new card.
    • The Card is received with instructions explaining how it is activated, how it is used and its expiry date.
    • Whilst the Card functions at any EFTPOS terminal, there may be instances where retailers decline to accept the Card as they may impose their own restrictions on the use of the card, such as minimum payment amounts.
    • Change will not be given by merchants for purchases using the card.
